These terms ("Terms") govern your use of bizzity.com (the "Site") and the Bizzity platform (the "Service"), operated by Bizzity. By using the Site or Service, you agree to these Terms.
1. The Service
Bizzity provides software for proposal generation, CRM, marketing automation, dashboards, and workflow automation, primarily for managed service providers (MSPs) and IT service businesses.
2. Your account
- You're responsible for keeping your login credentials secure.
- You're responsible for any activity under your account, including actions taken by team members you invite.
- Tell us right away at hello@bizzity.com if you suspect unauthorized access.
- You must be at least 18 years old to create an account.
3. Acceptable use
You agree not to:
- Use the Service to send spam or unsolicited messages
- Reverse-engineer, decompile, or extract source code from the Service
- Use the Service to host illegal content or violate third-party rights
- Attempt to disrupt or compromise the Service or other users' accounts
- Resell or sublicense the Service without our written agreement
4. Pricing and billing
- Bizzity costs $199.99/month for the standard plan, which includes 3 users. Additional users are $50/month each. A one-time $495 implementation fee applies when you sign up.
- Billing is monthly, charged on the same date each month, automatically on the payment method on file.
- You can cancel anytime by emailing hello@bizzity.com. Your access ends at the end of the current billing period. We don't refund partial months.
- Prices may change with 30 days' notice via email.
5. Your data
You own your data. Anything you upload, type, or generate inside Bizzity belongs to you. We have a license to store, process, and display it only to operate the Service for you.
We don't sell or rent your data. See the Privacy Policy for what we do collect and how it flows.
If you cancel, you can export your data for 30 days after cancellation. After that we may delete it on a routine schedule.
6. Free training and proposal review
Standard plans include free onboarding training and one free first-proposal review. These are services we provide as a courtesy and may modify or discontinue with reasonable notice.
7. Intellectual property
The Bizzity software, design, and brand (the "Bizzity IP") are owned by Bizzity. Your subscription gives you a non-exclusive, non-transferable license to use the Service. You don't get any ownership of the Bizzity IP.
8. Service availability
We work hard to keep the Service running, but we don't guarantee uninterrupted availability. Scheduled maintenance, third-party outages (Cloudflare, our payment processor, etc.), or rare bugs can cause downtime. We're not liable for losses caused by outages.
9. Termination
You can stop using the Service anytime by canceling. We can suspend or terminate your access if you violate these Terms or fail to pay. We'll give reasonable notice unless the violation requires immediate action (security, legal compliance).
10. Disclaimers
The Service is provided "as is" and "as available." Bizzity disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent allowed by law.
11. Limitation of liability
To the maximum extent allowed by law, Bizzity's total liability under these Terms is limited to the amount you paid us in the 12 months before the claim. We're not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, even if we knew the loss was possible.
12. Indemnification
You agree to indemnify and hold Bizzity harmless from claims arising out of your use of the Service in violation of these Terms or applicable law.
13. Changes to these Terms
We may update these Terms over time. We'll post the new version here and update the "Last updated" date. For material changes, we'll email account holders at least 30 days before the change takes effect.
14. Governing law and disputes
These Terms are governed by the State of New York, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in the State of New York, and you consent to that jurisdiction.
